By accessing or using Travel Magic Companion ("Service"), operated by IaOrana LLC ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.
Travel Magic Companion is a Telegram bot service that provides location-based storytelling, poetic navigation, and travel enhancement features. The Service transforms GPS coordinates into narrative experiences through our bot @TravelMagicStoryBot.
To use certain features of the Service, you must have a valid Telegram account. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4.1. The Service offers both free and paid subscription tiers as described on our website.
4.2. Paid subscriptions are billed monthly in advance and are non-refundable except as provided in our Refund Policy.
4.3. We reserve the right to change subscription fees upon 30 days' notice. Such notice may be provided through the Service or via email.
4.4. Payment processing is handled by our third-party payment processor. By providing payment information, you authorize us to charge the applicable fees to your payment method.
5.1. By sharing your location or other content with the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and display such content solely for the purpose of providing the Service.
5.2. You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service.
5.3. We reserve the right to terminate or suspend access to the Service for violations of these Terms.
6.1. The Service and its original content (excluding user content), features, and functionality are owned by IaOrana LLC and are protected by international copyright, trademark, and other intellectual property laws.
6.2. The poetic narratives, stories, and creative content generated by our Service are proprietary and may not be reproduced, distributed, or used for commercial purposes without our express written permission.
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as detailed in the Privacy Policy.
8.1. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
8.2. We do not guarantee the accuracy, completeness, or usefulness of any information provided by the Service.
8.3. Travel Magic Companion provides entertainment and enhancement to travel experiences but should not be relied upon as the sole source of navigation or safety information.
8.4. In no event shall IaOrana LLC be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.
8.5. Our total liability to you for any damages shall not exceed the amount paid by you to us in the twelve (12) months prior to the event giving rise to the liability.
You agree to indemnify and hold harmless IaOrana LLC, its officers, directors, employees, and agents, from any claims, damages, losses, liabilities, costs, and expenses arising out of your use of the Service or violation of these Terms.
10.1. Agreement to Arbitrate: You and IaOrana LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be determined by binding arbitration in Orange County, California, instead of in courts of general jurisdiction.
10.2. Arbitration Rules: Arbitration shall be initiated through JAMS (Judicial Arbitration and Mediation Services). If JAMS is not available to arbitrate, the parties shall agree to select an alternative arbitration provider. The rules of the arbitration provider shall govern all aspects of the arbitration, except to the extent such rules are in conflict with these Terms.
10.3. Arbitration Costs: The party initiating arbitration shall pay the initial filing fee. All other arbitration costs shall be divided equally between the parties, except that each party shall bear its own attorneys' fees.
10.4. Small Claims Court: Notwithstanding the foregoing, either party may bring an individual action in small claims court.
10.5. Class Action Waiver: You agree that any arbitration shall be conducted in your individual capacity only and not as a class action or other representative action. You expressly waive your right to file a class action or seek relief on a class basis.
10.6. 30-Day Right to Opt Out: You have the right to opt out of this arbitration agreement by sending written notice of your decision to opt out to: IaOrana LLC, [Address], within thirty (30) days of first using the Service.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. The exclusive venue for any dispute not subject to arbitration shall be the state and federal courts located in Orange County, California.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the Service or by email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
13.1. You may terminate your account at any time by discontinuing use of the Service.
13.2. We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms.
13.3. Upon termination, your right to use the Service will cease immediately.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and IaOrana LLC regarding the use of the Service.
